IMPORTANT NOTICE: Access to and use of this Website and the products and services available through this Website (collectively, the “Services”) are subject to the following terms, conditions and notices. By using the Services, you are agreeing to be legally bound by all of the Terms and Conditions of Services, as may be updated by us from time to time. You should check this page regularly to take notice of any changes we may have made to the Terms and Conditions of Services. Please read them carefully. If you do not agree to be bound by these Terms and Conditions of Services, you must not access the website.

In these Terms and Conditions, unless the context otherwise requires:

1.1. "Customer", "You", "Your" means any individual accessing the website or placing an order for goods;

1.2. "Goods" or "Merchandise" means the physical items available for purchase on the website, including apparels (clothes, lab coats, scrubs, hats) and accessories (flasks, tumblers, mugs, lanyards, pins, soft toys);

1.3. "Order" means an order submitted by you via the website to purchase goods from us.

1.4. "Third-Party Service Providers" includes our platform developer/maintainer, payment gateway provider, retail management system, and integrated courier service providers. 

1.5. "We", "Us", "Our", "The Shop" means Monash University Malaysia.

1.6. "Website" means the official e-commerce platform of the Monash Shop, currently accessible via: https://mumshop.monash.edu.my/

2.1. Eligibility: By using the Services, you represent and warrant that you are at least eighteen (18) years of age and possess the legal capacity to enter into a binding contract under the Contracts Act 1950 of Malaysia. We do not sell Goods and/or Merchandise to minors. If you are under eighteen (18) years of age, you may not use this Website to place orders. Any purchase under this Website must be transacted directly by an individual of legal age using their own registered account and authorised payment method.

2.2. Prohibition: You are strictly prohibited from misusing the Website or utilising the Services for any unlawful purpose. You shall not commit or encourage criminal acts; transmit viruses, logic bombs, Trojans, or other malicious components; breach system security or hack into any aspect of the Services; corrupt data; infringe upon third-party intellectual property rights; or transmit unsolicited commercial messages. Furthermore, You must not attempt to compromise the operational integrity or performance of any computing facilities supporting the Website. Breach of these restrictions may constitute a criminal offence under the Computer Crimes Act 1997, and We reserve the right to report such conduct to legal authorities.

2.3. Disclaimer: We accept no liability for any loss, destruction, or damage to Your computing devices, software applications, electronic data, or other proprietary materials resulting from cyberattacks, distributed denial-of-service (DDoS) incidents, viruses, or harmful components encountered while browsing the Website, downloading files, or navigating to external hyperlinked websites.

2.4. Account Registration: To place an Order, You must register for an online account by providing accurate, current, and complete details. Personal Data collected during account registration or through Your use of the Services will be collected, stored, processed, and shared with necessary Third-Party Service Providers strictly in accordance with the Personal Data Protection Act 2010 (PDPA) of Malaysia and the Monash University Malaysia Personal Data Protection Notice available at https://www.monash.edu.my/personal-data-protection-notice. You retain all statutory rights to access, correct, or withdraw Your consent regarding Your Personal Data at any time by contacting Us.

2.5. Account Responsibility: You are entirely responsible for maintaining the confidentiality of your account credentials and password. You accept  You accept full legal and financial responsibility for all activities and transactions conducted through Your account except where You have promptly notified Us of an unauthorised breach. If You suspect unauthorised access, You must notify Us immediately. We reserve the absolute right to suspend or terminate any account suspected of fraudulent or unauthorised activity without prior notice.

2.6. Personal Use: All purchases made on the Website are for personal use only. Purchasing on behalf of others, resale through any platform or arrangement, and the creation of multiple accounts to circumvent purchasing limits are not permitted. We reserve the right, in our sole discretion, to cancel orders, deactivate accounts, or restrict future purchasing access where a violation is identified.

3.1. Contract Formation: The display of Goods and Merchandise on this Website constitutes an invitation to treat. By placing an Order, You are making an offer to purchase the selected Goods and/or Merchandise. All Orders are subject to stock availability and confirmation of the Order price. A legally binding contract is only formed when We expressly accept Your offer by sending You an Order confirmation email, following successful payment verification through Our payment gateway. We reserve the right to cancel any Order at any time prior to issuing this confirmation.

3.2. Pricing: All prices are stated in Malaysian Ringgit (MYR), and shipping fees are calculated at checkout. While We make every effort to ensure accurate pricing and logistics calculations, typographical or system errors may occur. If We discover an error in the item price or shipping calculation of Your Order, We will notify You as soon as possible and give You the option to pay the corrected total or cancel the Order. If We are unable to contact You, the Order will be treated as automatically cancelled.

3.3. Order Cancellation: In the event of any Order cancellation initiated by Us, You will be notified via email. A full monetary refund will be processed back to Your original payment method within seven (7) to fourteen (14) working days, subject to payment gateway and issuing bank processing timelines.

4.1. Payment Gateway: All payments must be made in Malaysian Ringgit (MYR) via Our authorised payment methods displayed at checkout. Payments are processed securely through designated Third-Party Service Providers. By initiating a transaction, You agree to be bound by the respective terms, conditions, and privacy policies of these third-party payment gateway providers. Ownership of the Goods shall only pass to You upon Our full and irrevocable receipt of payment.

4.2. Payment Processing: We do not collect, store, or process your full credit card, debit card, or sensitive online banking credentials on our servers. While we strive to work with reputable service providers, We shall not be held liable for any loss, damage, delay, or failure of a transaction resulting from:

4.2.1. System downtime, maintenance, or technical errors on the part of the payment gateway provider or your issuing bank.

4.2.2. Unauthorised access, security breaches, or fraud occurring within the third-party payment gateway’s infrastructure.

4.2.2. Any rejection or decline of payment by your issuing bank or the payment gateway.

4.3. Payment Disputes: In the event of a payment error, bank decline, or suspected fraudulent transaction, You should contact Your issuing bank or payment provider directly. Where a technical glitch results in a duplicate payment received by Us, We will refund the duplicated amount back to Your original payment method, subject to Our internal verification.

5.1. Shipping Fees: Shipping fees and estimated delivery times are calculated at checkout. While We strive to process and dispatch orders promptly, delivery timelines provided are estimates only. Delivery durations may take longer than usual during festive seasons, customs clearance holds, or unforeseen local courier delays. Orders received on weekends or public holidays will be processed on the next business day. We are not liable for transit delays caused by customs authorities or external factors beyond Our reasonable control.

5.2. Risk of Loss: Risk of loss of or damage to the Goods shall pass to You upon physical delivery to Your designated address. You explicitly agree that Third-Party Service Providers may deliver parcels to residential addresses without obtaining a physical signature (including drop-offs at safe places, doorsteps, or via On-Demand Delivery instructions). Whether by Your specific instruction or standard courier practice, risk shall pass to You immediately upon the Third-Party Service Provider fulfilling that delivery. We disclaim all liability for any missing, stolen, or damaged Goods following confirmation of delivery by Our Third-Party Service Provider.

5.3. Tax and Duties: All international orders are shipped Delivered Duty Unpaid (DDU). Customs, VAT, and import duties are not included in Your order total or shipping cost and are Your sole responsibility. If You refuse delivery or fail to clear customs, Your order will be treated as cancelled by You. In such events, any eligible refund will be issued exclusively as store credit. We reserve the right to set off and deduct all direct costs incurred by Us as a result of Your cancellation under these circumstances from Your final store credit balance.

6.1. Limitation of Liability: To the maximum extent permitted by applicable law, Our total liability for any lost, damaged, or defective Goods occurring prior to the transfer of risk to You shall be strictly limited to the actual purchase price paid by You for the affected item(s).

6.2. Consequential Losses: We shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the purchase or delivery of the Goods, including but not limited to loss of profits, loss of opportunity, or reputational damage.

6.3. Delivery Claims: If Your order is damaged, incomplete, or missing, please report the issue to mum-monashshop@monash.edu with Your order number and supporting photos. To enable Us to process logistics claims with Our courier partners, all issues must be reported within fourteen (14) calendar days for local orders, and thirty (30) calendar days for international orders, calculated from the dispatch date. We will not entertain any reports made beyond these timelines.

7.1. Product Images and Description: Product photos, packaging images, and color displays on Our Website are for illustrative purposes only. While We strive to display colors accurately, We cannot guarantee that Your device’s screen display will precisely reflect the actual color of the Goods. Sise charts are provided for reference only.

7.2. Return Eligibility: All processed Orders are final. Returns and exchanges are strictly permitted only for:

7.2.1. Manufacturer defects or damaged Goods; or

7.2.2. Incorrect Goods relative to Your confirmed order (sise and colour).

7.3. Return Conditions: Where a return is authorised by Us, the Goods must be sent to the following address:

7.4. All returns must strictly adhere to the following conditions:

7.4.1. Proof of Purchase: Returns must be accompanied by proof of purchase (such as Your order confirmation email or receipt). Returns without proof of purchase will not be entertained.

7.4.2. Item Condition: Goods must be returned unworn, unwashed, unaltered, and in original condition with all packaging, tags, and labels fully intact.

7.4.3. Return Postage: Return postage costs will be borne by Us in cases of confirmed manufacturer defect or Our error. You are advised to use registered or trackable postal services, as We shall not be responsible for lost, undelivered, or damaged return goods prior to receipt. 

We reserve the right to reject returns that do not meet these conditions.

7.5. Return Procedure: If You receive a defective, damaged, or incorrect item, please report the issue to mum-monashshop@monash.edu within fourteen (14) calendar days (local orders) or thirty (30) calendar days (international orders) of delivery, providing Your Order number and clear photographic proof.

7.5.1. Replacement: Upon verification, We will arrange a direct replacement at Our expense and reimburse reasonable return postage costs incurred by You.

7.5.2. Out-of-Stock Items: If a defective or incorrect item cannot be replaced because it is out of stock or the last piece, You will receive a full monetary refund to Your original payment method (or store credit, if You prefer).

8.1. Data Collection: Basic details such as name, address, email, and credit card details are collected when you use the Services. By using the Services, you consent to the collection and processing of your personal data by Us in accordance with the Personal Data Protection Act 2010 (PDPA). 8.2. Third-Party Data Sharing: To fulfil your Order, your data may be shared with necessary Third-Party Service Providers strictly on a need-to-know basis. By accessing the Website  and using the Services, you expressly acknowledge and consent to this transfer of your personal data.

8.3. Liability: While Monash University Malaysia takes all reasonable and practicable steps to ensure that our third-party service providers comply with the Personal Data Protection Act 2010 (PDPA), we do not exercise direct control over their internal systems. To the maximum extent permitted by applicable law, We shall not be held liable for any unauthorised access, data breach, loss, or misuse of your personal data that occurs solely within the independent systems or infrastructure of these third-party service providers, provided that we have fulfilled our statutory obligations of care and security.

9.1. All content on the Website is the property of Monash University Malaysia or its content suppliers and is protected by Malaysian and international intellectual property laws.

9.2. Strict Prohibition: You are strictly forbidden from downloading, copying, or screenshotting our product photos, graphics, or logos to list, display, or sell items on any third-party platform.

9.3. Enforcement: Unauthorised use of our media constitutes copyright and trademark infringement. Monash University Malaysia reserves the absolute right to issue immediate takedown requests, initiate civil legal action, and claim full damages without prior notice.

These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia. In the event of any dispute arising from these terms or your use of the website, the parties submit to the exclusive jurisdiction of the courts of Malaysia.
